1. Limitation Act, 1963–Art. 65–Suit for declaration and possession–Limitation for filing the suit for possession is twelve years–Merely because one of the relief sought is of declaration that will not mean that the outer limitation of 12 years is lost–In the instant case, the main relief is for possession– Therefore, the suit will be governed by the provisions Art. 65.
2.Possession–Claim based on the title–Legal aspects for filing the suit–In a suit filed for possession based on title, the plaintiff is bound to prove his title and pray for a declaration that he is owner of the suit land because his suit on the basis of title cannot succeed unless he is held to have some title over the land.
