Penal Code, 1860–Sec. 302–Evidence Act, 1872–Sec. 32–Both the dying declarations of deceased are found reliable–Deceased stated that her husband poured the kerosene oil on her when she was sleeping and run away from the spot after setting her on fire–She stated also that her husband was suspecting her character–Second dying declaration was recorded by Magistrate after obtaining the certificate of fit mental state–Held, conviction was justified.
